1. Acceptance of Terms

By accessing and using OnSeason Storage ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access the materials (information or software) on OnSeason Storage for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials;
  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained on OnSeason Storage;
  • remove any copyright or other proprietary notations from the materials.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by OnSeason Storage at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Service Description

OnSeason Storage provides a storage management platform that allows users to:

  • Track and manage stored items
  • Request pickup and delivery of storage containers
  • Schedule transport services
  • Manage billing and payments
  • Access inventory through our mobile and web applications

3.5 Container Weight Limits and Requirements

3.5.1 Maximum Weight Per Container

Each container has a MAXIMUM WEIGHT LIMIT of 50 pounds (lbs) including the weight of the container itself and all contents.

You are responsible for ensuring containers do not exceed this weight limit.

3.5.2 Why We Have Weight Limits

Weight limits exist for:

  • Driver and staff safety (lifting, handling, loading, unloading)
  • Vehicle safety and legal weight limits
  • Prevention of container damage
  • Compliance with workplace safety regulations
  • Insurance requirements

Exceeding weight limits creates safety hazards and violates these Terms.

3.5.3 Consequences of Overweight Containers

If a container exceeds the weight limit:

At Pickup:

  • Our driver will refuse to accept the overweight container
  • You will be charged a $75 failed pickup fee for the wasted trip
  • The container must be repacked to comply with weight limits
  • You must schedule and pay for a new pickup appointment

At Delivery:

  • If a container is heavy or delivery location has safety concerns (stairs, narrow walkways, unstable surfaces), we may leave the container at the curb/driveway rather than carrying it to unsafe locations
  • You are liable for any injuries caused by attempting to move heavy containers yourself

3.5.4 How to Avoid Overweight Containers

Tips for staying within weight limits:

  • Distribute heavy items across multiple containers
  • Place books, tools, and heavy items in smaller boxes first, then transfer to our containers
  • Avoid filling containers completely with heavy items
  • Use kitchen scales or bathroom scales to check weight before packing
  • When in doubt, pack lighter - it's easier to use multiple containers than repack

Items That Are Typically Heavy:

  • Books and magazines
  • Tools and hardware
  • Dishes and kitchenware
  • Electronics
  • Small appliances
  • Weights and exercise equipment
  • Tiles, bricks, or building materials

3.5.5 Driver Authority to Refuse Overweight Containers

Our drivers have full authority to refuse any container that:

  • Appears to exceed weight limits
  • Cannot be safely lifted by one person
  • Causes the container to bulge, sag, or deform
  • Feels unstable or off-balance when lifted

Driver decisions are final and made for safety reasons. You cannot dispute a driver's assessment of weight at the time of pickup or delivery.

3.5.6 Liability for Overweight Containers

You acknowledge and agree that:

  • Proper weight compliance is YOUR responsibility
  • We are not liable for items damaged in overweight containers
  • We are not liable for injuries caused by overweight containers
  • Overweight containers void our liability coverage (even the $500 base amount)
  • You will indemnify us for any injuries or damage caused by overweight containers

3.5.7 Repeated Violations

Repeatedly providing overweight containers or attempting to conceal excessive weight may result in:

  • Account termination
  • Refusal of future service
  • Ban from using OnSeason Storage
  • Legal action for damages or injuries caused

3.6 Climate-Controlled Storage Disclaimer

3.6.1 What Climate-Controlled Means

We store your containers in climate-controlled storage facilities operated by third-party providers such as Public Storage. Climate-controlled storage means facilities with temperature moderation systems, typically maintaining temperatures between 55°F and 85°F.

IMPORTANT: Climate-controlled does NOT mean temperature-guaranteed or precision climate control.

3.6.2 What We Do NOT Guarantee

Even in climate-controlled facilities, we do NOT guarantee:

  • Specific constant temperatures
  • Temperature without fluctuation or variation
  • Precise humidity control or monitoring
  • Protection from all temperature-related damage
  • HVAC system operation without interruption
  • Backup systems during power outages or equipment failures

3.6.3 Environmental Risks

We are NOT liable for damage caused by:

  • Temperature fluctuations within the 55°F-85°F range
  • Humidity, condensation, or moisture accumulation
  • HVAC system failures or maintenance outages
  • Power outages affecting climate control systems
  • Extreme weather conditions affecting facility temperatures
  • Seasonal temperature variations
  • Mold, mildew, rust, or corrosion

3.6.4 Items Requiring Specific Temperatures

If you have items requiring specific temperatures or conservation-grade climate control (wine, antiques, musical instruments, artwork, medications, etc.), our climate-controlled storage may NOT be appropriate.

See Section 7.5.9 for a detailed list of temperature-sensitive items and associated risks.

By storing temperature-sensitive items with us, you acknowledge:

  • You understand the limitations of climate-controlled storage
  • You accept all risk of temperature-related damage
  • Our $500 per container liability limit applies to temperature damage
  • You should obtain additional insurance for valuable temperature-sensitive items

3.6.5 Third-Party Facility Control

Temperature and climate control systems are owned, operated, and maintained by third-party storage facility providers. We do not own or control these systems. Our liability is limited to selecting reputable facilities with climate-controlled capabilities.

Facility operators may perform maintenance, adjust settings, or experience equipment failures beyond our control. We are not liable for facility operator actions or equipment failures.

3.7 Pickup and Delivery Terms

3.7.1 Scheduling and Appointments

All pickups and deliveries must be scheduled through our platform. Once you select and confirm a time slot, your appointment is locked in.

We will notify you when the driver is en route. You do not need to confirm the appointment again after booking.

3.7.2 Pickup and Delivery Fees

  • Pickups are always FREE - no charge to pick up filled containers from your location
  • Initial dropoff is included with your service
  • One free dropoff per subscription renewal - each time your subscription renews, you receive one complimentary delivery
  • Additional dropoffs beyond your included delivery will incur a delivery fee

Delivery fees for additional dropoffs will be clearly displayed when scheduling.

3.7.3 Your Responsibilities

To ensure successful pickup or delivery, you must:

  • Provide accurate address and access information (gate codes, building access, parking instructions)
  • Ensure containers are at the designated location for pickup (porch, driveway, garage, etc.)
  • Provide safe vehicle access - parking within reasonable distance, no blocked driveways
  • Notify us of any obstacles or access issues (stairs, narrow walkways, construction, aggressive pets)
  • Ensure containers comply with weight limits (50 lbs maximum per container)

3.7.4 Presence Not Required

You do NOT need to be present for pickup or delivery. You may:

  • Leave containers on your porch, driveway, or designated location for pickup
  • Authorize us to leave delivered containers at your designated location
  • Provide access instructions for secured areas (gate codes, lockbox codes)

By scheduling pickup or delivery, you authorize us to access your property and pick up or drop off containers at the designated location.

3.7.5 Failed Pickup/Delivery Situations

A $75 failed service fee applies if our driver arrives and cannot complete the job due to:

  • No access to property (locked gates without codes, no parking, blocked driveway)
  • Containers not at designated location for pickup
  • Unsafe conditions (aggressive unleashed animals, hazardous conditions, unstable surfaces)
  • Containers exceeding weight limits (driver authority to refuse - see 3.7.6)
  • Incorrect or incomplete address information

Note: We will make reasonable efforts to contact you if issues arise, but the failed service fee applies if the appointment cannot be completed due to issues on your end.

3.7.6 Driver Authority and Safety

Our drivers have full authority to:

  • Refuse to transport containers that appear overweight (exceed 50 lb limit)
  • Refuse service if conditions are unsafe (aggressive animals, hazardous walkways, unstable stairs)
  • Refuse containers suspected to contain prohibited items (odors, leaks, unusual weight)
  • Cancel the appointment if access is not possible
  • Take photos documenting conditions, container condition, and location issues

Driver safety decisions are final and made for the protection of our staff. You cannot dispute a driver's safety assessment at the time of service.

3.7.7 Rescheduling After Failed Attempts

If a pickup or delivery fails due to issues on your end:

  • You must pay the $75 failed service fee before rescheduling
  • You must resolve the access, weight, or safety issues
  • You must schedule a new appointment

3.7.8 Weather and Circumstances Beyond Our Control

We may need to reschedule pickups or deliveries due to:

  • Severe weather conditions
  • Road closures or natural disasters
  • Vehicle breakdowns or driver emergencies

In these cases, we will notify you as soon as possible and reschedule at no additional charge.

3.8 Container Ownership and Care

3.8.1 You Own the Containers

Containers provided to you as part of your OnSeason Storage service become YOUR PROPERTY. You may keep containers even after canceling your storage service subscription.

This is a key benefit of OnSeason Storage - the containers are yours to keep!

3.8.2 Your Responsibilities While Using Our Service

While you are an active OnSeason Storage customer, you are responsible for:

  • Proper care and maintenance of containers in your possession
  • Keeping containers clean and free from damage
  • Not modifying, painting, or altering containers
  • Using containers only for permitted items (see Section 7.5 Prohibited Items)
  • Protecting containers from weather, pests, and damage while in your possession
  • Making containers available for scheduled pickup

3.8.3 Severely Damaged Containers

If a container is severely damaged while in your possession (broken, structurally unsound, unsafe to transport), we reserve the right to refuse to pick it up and return it to storage.

This protects our drivers from handling unsafe containers during transport. Normal wear and tear is expected and acceptable. This only applies to containers that are unsafe to handle or transport.

Remember - you own the containers! Once you cancel your subscription, you keep them regardless of condition.

3.8.4 After Service Cancellation

After you cancel your storage service:

  • The containers remain yours - keep them!
  • You may use them for personal storage, moving, or any lawful purpose
  • We have no further claim to the containers
  • You are not required to return containers to us

3.9 Your Location Liability and Safety

3.9.1 Safe Access and Conditions

You are responsible for providing safe conditions at your pickup and delivery locations. This includes:

  • Clear, well-lit pathways free from obstacles
  • Secure, non-aggressive pets (or pets secured away from drivers)
  • Safe stairs, ramps, or walkways
  • Warning of any hazards (wet floors, uneven surfaces, low clearances)
  • Adequate space for driver to safely maneuver
  • Compliance with local safety regulations

3.9.2 We Are Not Liable for Injuries at Your Location

We are NOT liable for injuries or accidents that occur at your location unless caused by our gross negligence. You are responsible for:

  • Injuries from slips, trips, or falls at your property
  • Injuries from unsafe conditions you failed to disclose
  • Injuries from your pets or animals
  • Injuries from defects in your property (broken stairs, uneven surfaces)
  • Property damage at your location

3.9.3 Indemnification for Location Issues

You agree to indemnify and hold OnSeason Storage harmless from any claims, injuries, or damages arising from:

  • Unsafe conditions at your property
  • Your failure to warn of hazards
  • Injuries to our drivers or staff caused by your property or pets
  • Third-party claims related to service at your location

3.10 Late Payments and Collection

3.10.1 Payment Due Dates

Storage fees are billed annually on your subscription anniversary date. Payments are processed automatically using your payment method on file. You must keep a valid payment method current.

3.10.2 Late Payment Consequences

If payment fails or is not received:

After 15 Days Late:

  • $25 late payment fee assessed
  • Email and SMS notifications sent
  • Account marked as past due

After 30 Days Late:

  • Access to containers suspended (no deliveries until paid)
  • Additional $25 fee assessed
  • Account subject to collections referral

After 60 Days Late:

  • We may exercise lien rights (see Section 3.10.3)
  • Account referred to collections agency
  • Late fees continue to accrue at 1.5% per month on unpaid balance
  • Credit bureaus may be notified

3.10.3 Lien Rights

By using our service, you grant OnSeason Storage a contractual lien and security interest in all stored items to secure payment of fees, charges, and expenses.

If your account is 60+ days past due, we may:

  • Refuse to return stored items until all fees are paid in full
  • Exercise our lien by selling stored items to recover unpaid fees
  • Dispose of stored items deemed to have no resale value
  • Charge you for all collection costs, legal fees, and storage fees

Notice Required: We will provide 30 days written notice to your last known address and email before exercising lien rights. You will have 30 days from notice to pay all outstanding amounts plus fees to reclaim your items.

3.10.4 Collection Costs

If your account is sent to collections or we must take legal action, you are responsible for:

  • All outstanding storage fees and late fees
  • Collection agency fees (up to 40% of balance)
  • Attorney fees and court costs
  • Interest at the legal maximum rate

4. User Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree to notify us immediately of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity that is not lawfully available for use.

5. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

6. Packing Requirements and Your Responsibilities

6.1 You Pack Your Own Containers

You are responsible for packing all items placed in OnSeason Storage containers. We do not pack items for you, and we do not inspect how you pack your containers.

6.2 What Proper Packing Means

To protect your belongings during transport and storage, you must:

  • Wrap fragile items (glass, ceramics, electronics) in bubble wrap or padding
  • Use cushioning material to prevent items from shifting during normal handling
  • Place heavier items on the bottom of containers
  • Avoid overfilling - container lids must close flat without bulging
  • Keep items away from container edges where possible
  • Use appropriate container sizes for your items

6.3 Damage from Improper Packing Is Not Covered

We are not liable for damage to items that were improperly packed, even if the damage occurs during our transport or storage. This includes damage from:

  • Insufficient padding or wrapping
  • Items shifting during normal transport and handling
  • Overfilled or bulging containers
  • Contact between unprotected fragile items
  • Using containers that are too large or too small for the items

You assume all risk for items that are not properly packed according to these requirements.

6.4 IMPORTANT: $500 Maximum Coverage Per Container

Our liability for any damage or loss is limited to a maximum of $500 per container, regardless of the actual value of your items.

We do NOT offer:

  • Enhanced or upgraded coverage plans
  • Additional insurance options
  • Higher liability limits
  • Exceptions to the $500 per container maximum

This $500 limit applies even if your items are worth more and even if you told us about their value.

6.5 High-Value Items - You Must Get Your Own Insurance

If you are storing items worth more than $500 per container, or irreplaceable items (jewelry, antiques, collectibles, family heirlooms, electronics, artwork):

YOU ARE STORING THESE ITEMS AT YOUR OWN RISK BEYOND $500.

We strongly recommend that you:

  • Contact your homeowner's or renter's insurance provider to verify coverage for items in storage
  • Obtain separate storage insurance from a third-party insurance provider
  • Take photos of valuable items before packing
  • Maintain a detailed inventory with estimated values
  • Consider whether storage is appropriate for irreplaceable items

By using our service, you acknowledge that our coverage is limited to $500 per container and you accept full risk for any value beyond that amount.

6.6 Items We Recommend You Do Not Store

Due to our limited coverage and the risks of damage, we recommend you do NOT store:

  • Irreplaceable documents (original birth certificates, wills, deeds)
  • Family heirlooms with sentimental value
  • Items worth more than $500 unless you have your own insurance
  • Extremely fragile items that require specialized handling
  • Items that cannot be replaced

While we handle all containers with reasonable care, we cannot guarantee that items will not be damaged during transport or storage.

7. Prohibited Uses

You may not use our Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts;
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances;
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate;
  • To submit false or misleading information;
  • To upload or transmit viruses or any other type of malicious code;
  • To interfere with or circumvent the security features of the Service.

7.5 Prohibited Items - What You Cannot Store

The following items are STRICTLY PROHIBITED from storage in OnSeason Storage containers. Storing prohibited items is a material breach of these Terms and may result in immediate termination, disposal of items at your expense, and legal action.

7.5.1 Hazardous and Flammable Materials

You may NOT store:

  • Explosives, fireworks, ammunition, or blasting caps
  • Flammable liquids (gasoline, kerosene, oil, lighter fluid, paint thinner, solvents)
  • Flammable gases (propane tanks, butane, helium, oxygen, acetylene)
  • Corrosive materials (acids, bases, cleaning chemicals, pool chemicals)
  • Toxic or poisonous substances
  • Radioactive materials
  • Asbestos or asbestos-containing materials
  • Paint, varnish, or stains (opened or unopened)
  • Fuel of any kind
  • Motor oil, grease, or automotive fluids

7.5.2 Perishable Items and Organic Materials

You may NOT store:

  • Food of any kind (canned, packaged, frozen, fresh, or prepared)
  • Perishable goods
  • Plants, seeds, or plant materials
  • Items that will decay, rot, or decompose
  • Items that emit odors or attract pests
  • Garbage or waste materials

7.5.3 Living Things

You may NOT store:

  • Animals, birds, fish, or any living creatures (alive or dead)
  • Animal remains or taxidermy
  • Pet food (attracts pests)

7.5.4 Illegal Items and Controlled Substances

You may NOT store:

  • Illegal drugs or drug paraphernalia
  • Stolen property or items used in commission of crimes
  • Counterfeit goods or items violating intellectual property rights
  • Items obtained through illegal means
  • Evidence of crimes or items subject to criminal investigation

7.5.5 Weapons and Ammunition

You may NOT store:

  • Firearms (handguns, rifles, shotguns - loaded or unloaded, registered or unregistered)
  • Ammunition or bullets
  • Explosives or incendiary devices
  • Weapons of any kind (knives over certain lengths may be prohibited by local law)
  • Military ordnance or weaponry

Note: Laws vary by jurisdiction. Even if legal to own, firearms and weapons are prohibited from storage with OnSeason Storage.

7.5.6 Valuable and Irreplaceable Items (Strongly Discouraged)

Due to our $500 per container liability limit, we STRONGLY DISCOURAGE storage of:

  • Cash, currency, coins, or bullion
  • Securities, stocks, bonds, or negotiable instruments
  • Jewelry, gems, or precious metals (unless adequately insured separately)
  • Original legal documents (birth certificates, passports, wills, deeds, titles)
  • Irreplaceable family heirlooms
  • Artwork worth more than $500
  • Collectibles worth more than $500 (stamps, cards, memorabilia)
  • Electronics worth more than $500 per container

If you choose to store these items despite our recommendation, you do so at your own risk and acknowledge our $500 per container maximum liability.

7.5.7 Items That Can Cause Damage

You may NOT store:

  • Wet, damp, or moist items (must be completely dry)
  • Items with mold, mildew, or active infestations
  • Items that can leak, drip, or seep
  • Items with strong chemical odors
  • Items that could damage other stored property
  • Tires or automotive parts with fluids
  • Batteries (car batteries, lithium batteries that could catch fire)
  • Firewood or lumber (attracts pests)

7.5.8 Items Prohibited by Storage Facilities

You may NOT store:

  • Any items prohibited by our third-party storage facility providers (including Public Storage)
  • Items that violate facility insurance policies
  • Items that violate local, state, or federal laws regarding storage
  • Items requiring specialized storage conditions we cannot provide

7.5.9 Temperature-Sensitive and Fragile Items (High Risk)

While not strictly prohibited, these items are stored AT YOUR RISK due to environmental conditions even in climate-controlled storage:

High-Risk Items:

  • Wine collections requiring precise temperature (55-58°F constant)
  • Antique furniture sensitive to humidity changes
  • Musical instruments requiring specific humidity (guitars, pianos, violins)
  • Artwork requiring conservation-grade climate control
  • Electronics sensitive to temperature fluctuations
  • Photographs or film requiring archival conditions
  • Medications requiring refrigeration or specific temperatures
  • Cosmetics or toiletries that can melt or freeze
  • Candles or wax items (can melt)
  • Vinyl records (can warp)

We provide climate-controlled storage (typically 55°F-85°F) but DO NOT guarantee:

  • Specific temperatures
  • Constant temperature without fluctuation
  • Precise humidity control
  • Protection from temperature-related damage

If you store temperature-sensitive items, you acknowledge:

  • We disclaim liability for temperature-related damage
  • Climate-controlled does NOT mean temperature-guaranteed
  • HVAC systems may fail or require maintenance
  • You assume all risk beyond our $500 per container limit

7.5.10 Consequences of Storing Prohibited Items

If we discover prohibited items in your containers, we may:

Immediate Actions:

  • Terminate your account effective immediately without refund
  • Refuse to return containers until prohibited items are removed
  • Remove and dispose of prohibited items at your expense (minimum $250 disposal fee)
  • Report illegal items to law enforcement
  • Ban you from future use of OnSeason Storage services

Your Liability:

  • You forfeit all fees paid (no refunds for terminated accounts)
  • You are liable for all disposal costs, handling fees, and administrative costs
  • You are liable for any damage caused by prohibited items to:
    • Our containers and equipment
    • Storage facilities or property
    • Other customers' stored property
    • Injuries to our staff, facility operators, or other customers
  • You are liable for any fines, penalties, or legal fees we incur
  • We may pursue legal action to recover damages and costs

Criminal Liability:

  • Storing illegal items may result in criminal charges
  • We will cooperate fully with law enforcement
  • You waive any claims against us for reporting illegal items

7.5.11 Your Representations and Warranties

By using OnSeason Storage, you represent and warrant that:

  • All items you store comply with this prohibited items list
  • You have disclosed any items that may be considered high-risk
  • You have not stored any illegal, hazardous, or prohibited items
  • You accept full responsibility for items you choose to store
  • You will indemnify and hold us harmless from any claims arising from your stored items

7.5.12 Inspection Rights

We reserve the right to inspect containers at any time if we have reasonable suspicion of prohibited items, including but not limited to:

  • Odors emanating from containers
  • Leaks or moisture
  • Unusual weight
  • Reports from facility operators
  • Pest activity
  • Legal requirements or law enforcement requests

You consent to such inspections by using our service. We will make reasonable efforts to notify you, but may inspect without notice if safety or legal concerns exist.

8. Payment Terms

Certain aspects of the Service may be provided for a fee. You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account and payment information.

You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon making your purchase.

9. Disclaimer

The materials on OnSeason Storage are provided on an 'as is' basis. OnSeason Storage makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, OnSeason Storage does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

10. Liability Limitations and Maximum Coverage

10.1 Maximum Liability - $500 Per Container

Our total liability for any loss, damage, or claim related to your stored items is LIMITED TO A MAXIMUM OF $500 PER CONTAINER, regardless of:

  • The actual value of your items
  • Whether you told us about the value
  • How the damage or loss occurred
  • The number of items in the container
  • Your insurance coverage or lack thereof

This $500 per container limit is our absolute maximum liability under any legal theory including negligence, breach of contract, or strict liability.

10.2 We Are Not Insurers

OnSeason Storage is a storage service provider, NOT an insurance company. We do not provide insurance coverage for your items. Our $500 per container limit is a liability limitation, not an insurance policy.

10.3 What We Are NOT Liable For

We are not responsible for any damage, loss, or claims arising from:

Improper Packing:

  • Items damaged due to insufficient padding or protection (see Section 6)
  • Items not packed according to our packing requirements
  • Fragile items that broke due to inadequate wrapping

Third-Party Storage Facilities:

  • Actions or failures of third-party storage facility operators (Public Storage, etc.)
  • Storage facility closures, access restrictions, or policy changes
  • HVAC system failures or power outages at storage facilities
  • Security breaches at third-party facilities
  • Fire, flood, or other damage at facilities we do not own or control

Environmental Conditions:

  • Temperature fluctuations (even in climate-controlled storage)
  • Humidity, condensation, or moisture
  • Mold, mildew, or rust
  • Insects, rodents, or pests

Acts of God and Events Beyond Our Control:

  • Natural disasters (hurricanes, tornados, earthquakes, floods)
  • Fire, explosion, or smoke damage not caused by our negligence
  • Theft by third parties
  • Vandalism
  • War, terrorism, civil unrest
  • Pandemics or government-mandated closures

Prohibited or Undisclosed Items:

  • Prohibited items (see Section 7.5)
  • Items not listed in your inventory
  • High-value items you did not disclose
  • Items we told you not to store

Customer Actions or Failures:

  • Your failure to be available for pickup or delivery
  • Damage from your improper handling of containers
  • Your failure to report damage within required timeframes
  • Your violation of these Terms

10.4 Excluded Damages - What We NEVER Pay For

Even if we are found liable within the $500 per container limit, we are NEVER liable for:

  • Consequential or indirect damages
  • Lost profits or business interruption
  • Loss of use or rental value
  • Emotional distress or mental anguish
  • Sentimental value (family heirlooms, irreplaceable items)
  • Punitive or exemplary damages
  • Attorney's fees or legal costs (except as required by law)
  • Damages beyond the $500 per container limit

Example: If we damage a container with your grandmother's wedding dress (sentimental value: priceless), we are only liable for up to $500, not the sentimental or emotional value.

10.5 Third-Party Service Providers

We use third-party service providers for storage facilities, transportation, and other services. Our liability for third-party actions is limited to:

  • Reasonable care in selecting qualified service providers
  • Maximum of $500 per container even if third-party caused the damage

We are NOT responsible for third-party negligence, misconduct, or failures unless we failed to use reasonable care in selecting them.

10.6 Your Responsibility to Mitigate Damages

If damage occurs, you must take reasonable steps to prevent further damage (mitigation of damages). We are not liable for damage that could have been prevented by reasonable action on your part.

10.7 Multiple Containers

If you have multiple containers and multiple containers are damaged:

  • Each container is subject to the $500 maximum
  • Our total liability is $500 × number of affected containers
  • Maximum aggregate liability per incident: $5,000 regardless of number of containers

Example: If 10 containers are damaged in one incident, our maximum total liability is $5,000 (not $5,000 per container).

10.8 Burden of Proof

To recover any amount, you must prove:

  • The damage occurred during our custody (not before or after)
  • We were negligent or breached our obligations
  • The actual cash value of damaged items (with receipts, photos, or appraisals)
  • The damage was not caused by improper packing or prohibited items

Without adequate proof, we may deny your claim entirely.

10.9 Claims Process Required

All claims must follow our claims process (see Section 10.10). Failure to follow the process may result in denial of your claim.

10.10 How to File a Damage Claim

To file a claim for damaged items, you must:

  1. Report damage within 7 days of delivery or discovery
  2. Submit a written claim including:
    • Description of damaged items
    • Photos of damage
    • Original photos of items before packing (if available)
    • Proof of value (receipts, appraisals, invoices)
    • Inventory records showing items were in the container
    • Description of how damage occurred (if known)
  3. Allow us to inspect damaged items if requested
  4. Cooperate with our investigation
  5. Provide any additional documentation we request

Claims not submitted within 7 days or without required documentation will be denied.

We will review and respond to claims within 30 days. Our decision is final unless you pursue legal action.

10.11 Legal Action Time Limit

Any legal action against OnSeason Storage for damage or loss must be filed within ONE YEAR from the date of the incident. Claims filed after one year are barred.

10.12 Jurisdictions Where Limitations May Not Apply

Some states do not allow limitations on implied warranties or liability for consequential damages. If you live in such a state, some limitations above may not apply to you, but our $500 per container maximum liability still applies to the fullest extent permitted by law.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
